He was taken to Queens Hospital where he was arrested and charged with aggravated unlicensed operation of a motor vehicle. We offer our deepest condolences to the family of Trevor Lloyd Samuels for their tragic and heartbreaking loss. They will be in our thoughts and prayers.
Head injuries are increasingly common in crosswalk accidents involving pedestrians and mopeds or e-bikes, especially at busy city intersections where riders may travel quickly or disregard traffic signals. When a pedestrian is struck by a moped and suffers a head injury such as a concussion, skull fracture, or traumatic brain injury, the law provides important protections and avenues for compensation.
What Are Pedestrians’ Rights?
Victims have the right to pursue a personal injury claim against the moped driver if the rider was negligent. Negligence (carelessness) may include actions including but not limited to speeding, failing to yield in a crosswalk, riding on the wrong side of the road, ignoring traffic signals, etc. Even if the moped is rented through an app-based service, the individual rider is responsible for operating it safely, and the moped owner is also liable.
Pedestrians may seek compensation for medical expenses, lost wages and benefits, past and future pain and suffering, rehabilitation, long-term disabilities, etc. Importantly, victims also have the right to request police reports, gather witness statements, and obtain video footage, which can significantly strengthen their case. Because severe injuries including head injuries can worsen over time, prompt medical evaluation and legal guidance are essential to protecting a victim’s rights. If the pedestrian accident results in death, the victim’s family may be able to seek compensation from the at-fault parties by filing a wrongful death lawsuit for damages such as medical expenses, lost future income, pain and suffering, etc.
