Driver Strikes and Seriously Injures Construction Worker in Manhattan

A worker was severely injured in a pedestrian accident near a construction site after an out-of-control vehicle crashed into him. According to a news report in the New York Daily News, the 47-year-old worker was in the crosswalk on East 85th Street at Park Avenue on his way to work when a vehicle came hurtling toward him. The vehicle was headed downtown on Park Avenue when it struck a cab making a U-turn, lost control and hit the worker, knocking him to the sidewalk.
The car jumped the curb and did not come to a stop until it slammed into scaffolding around the Park Avenue Christian Church, which is right next to the construction site. The vehicle hit the front of the cab, went over the sidewalk before hitting the worker. Medics transported the injured worker to a local hospital where he was listed in serious but stable condition. The driver of the vehicle and her young son were transported to a hospital with non-life-threatening injuries. The cab driver was treated at the scene. No one was charged or arrested. The investigation is ongoing.

NYC Pedestrian Accidents
According to recent statistics, while traffic accident deaths declined overall in New York City in 2016, pedestrian accident fatalities increased to 144, up from 139 in 2015. The surge in pedestrian accidents continues in 2017 and bicycle accident deaths have also increased from 14 to 18, statistics show.
Pedestrian accidents occur due to a variety of factors from excessive speed and distracted driving to DUI drivers, dangerous roadways and failure on the part of motorists to yield the right of way to pedestrians. Pedestrian accidents tend to cause major or catastrophic injuries that leave victims with lifelong disabilities. Some victims may be unable to work for extended periods of time and others may be unable to ever earn a livelihood.
Compensation for Victims
Victims of pedestrian accidents may be able to seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. If you have lost a loved one in a pedestrian accident, you may be able to file a wrongful death claim seeking compensation as well.
Please remember that you can seek compensation for your losses even if you were walking outside the crosswalk at the time the vehicle struck and injured you. If you were injured in a pedestrian accident on the job, you may also be able to seek workers’ compensation benefits, which usually covers medical expenses and a portion of lost wages, etc.
If you have been injured in a pedestrian accident, there are a number of steps you can take in order to protect your legal rights. First, file a police report and make sure you get a copy of the report for your records. Your attorney can obtain a copy of the police report as well. Try to get as much evidence from the scene of the accident including photographs, eyewitness contact information, physical evidence, etc. Get prompt medical attention, treatment and care for your injuries. Save all receipts and invoices connected with the incident. Immediately contact an experienced pedestrian accident lawyer who will stay on top of the official investigation and help ensure that your legal rights and best interests are protected.
