Building CollapseA worker was killed in a New York construction accident while he was demolishing a basement in the Bronx. According tothe New York Times, the 51-year-old man was working on Story Avenue when about 12 pillars in the basement of a two-story commercial building collapsed, which caused the building to cave. Two other workers were able to get out and escape injury. Firefighters pulled the debris off the worker. He was buried under about six feet of materials. The man was taken to Jacobi Medical Center where he later died.
According to theU.S. Department of Labor(DOL), there are approximately 150,000 construction accidents every year in the United States. While many of these cases result in injury, more than 1,000 are fatal. Often, injuries sustained in a construction site accident require the worker to miss more than a month of work. One out of every 10 construction workers will be injured on this job this year, based on these numbers.
Falls are the most common type of construction site accidents but building collapses and machinery malfunctions can also cause injury, or even death. Employers are responsible for making sure the work environment adheres to Occupational Safety and Health Administration (OSHA) standards. They are also responsible for verifying the site is safe and being maintained up to local codes. Employers are also required to make sure their workers have the proper safety gear including hard hats, harnesses, vests, and goggles.
If you have been injured in a construction accident because of an employer’s negligence, or negligence on the part of a third party such as a general contractor, sub-contractor, property owner, or product manufacturer, you may have a civil case. Workers may be able to seek compensation for damages including, but not limited to, lost wages and benefits, and past and future pain and suffering.
