construction siteA New York man was injured in a roadway construction site accident after he was struck by a driver who then left the scene of the crash. According to a news report in The Record, the injury collision occurred at the intersection of Colonial Road and Summit Avenue in Franklin Lakes, New Jersey. Officials say the worker, who was a flag man regulating traffic in the construction zone, was hit by a dark-colored SUV that was northbound on Colonial Road.
The injured worker was transported to a local hospital with moderate injuries. His employer, Allstate Power-Vac Industrial Services, was cited with violating a borough ordinance for not having proper warning signs leading up to the site among other safety measures. The U.S. Occupational Safety and Health Administration (OSHA) is investigating the incident as well.
Construction Site Dangers
Workers are typically at risk due to several kinds of vehicles, including trucks, backhoes and forklifts that operate at roadway construction sites. If vehicle safety practices are not observed at the site, workers may be potentially pinned between construction vehicles and walls, struck by swinging backhoes, or crushed under overturned vehicles. Passenger and other vehicles that use the roadways near the work site pose a hazard to the workers as these cars or trucks may hit and injure them.
In this particular case, officials say the construction company did not protect its workers and failed to post caution signs leading up to the work site. The victim in this case was struck by a driver who failed to remain at the scene, which is against the law. New York law requires all motorists to remain at the scene of an injury accident, regardless of whose fault the accident may have been.
Compensation for Injured Workers
Injured workers can seek monetary support by filing a workers’ compensation claim, which usually covers medical expenses and a portion of the lost wages. In addition, injured workers may be able to file a third-party claim against a party, other than the employer, whose negligence may have caused or contributed to the incident. Examples of third parties include general contractors, sub-contractors, property owners, manufacturers of defective products, etc.
