Car AccidentTwo teens were injured in a Brooklyn car accident when a vehicle jumped a curb and struck them. According to a recent article in The New York Daily News, the serious injury accident occurred at McDonald Avenue and Avenue I in Midwood. The Brooklyn car accident involved a black Nissan Maxima which veered out of control, struck the two teenagers on the sidewalk and then crashed into a bagel shop. The two teenagers who were outside the bagel shop were seriously injured. Four others who were inside the store were injured as well. All six injured victims of this car crash were hospitalized. Officials are investigating what caused this accident.
A driver does not have to be cited, arrested or criminally charged by the authorities in order to be held civilly liable for the damages he or she causes. In a civil lawsuit, all that victims have to do is prove that the driver was responsible for the crash. In such claims, a number of questions could arise. Was the driver speeding or driving distracted? Was the motorist under the influence of alcohol? Did the driver hit the gas instead of the brakes? If it is determined that the driver caused the crash, then, he or she could be held liable for the resulting injuries, damages and losses.
The New York Department of Motor Vehicles reported that in 2009, 307 pedestrians were killed and 15,321 pedestrians were injured in New York car accidents. In cases where negligent drivers are involved, pedestrian accident victims could seek compensation for medical expenses, loss of wages, cost of hospitalization, physical therapy, pain and suffering, and emotional distress.
