Car accidentSeven people were killed in a New York car accident after the Honda Pilot SUV in which they were traveling went off Bronx River Parkway and fell nearly 60 feet into a ravine. According to an ABC News report, the fatal car accident occurred when the SUV clipped a highway divider and damaged a tire. The Honda then plunged roughly the length of six stories before landing on the grounds of the Bronx Zoo. The crash fatally injured three generations of a family who were in the vehicle. Three of the victims were girls aged 12, 10 and 3. The other victims were an 85-year-old man and three woman, ages 80, 45 and 30.
We offer our deepest sympathies to this family that has tragically lost seven of its members. They will be in our thoughts and prayers.
Safety advocates are saying that the parkway, which was designed in 1907, has been seen as dangerous and deadly for decades, but largely ignored. AAA officials have said that the stretch of the roadway where this terrible accident occurred has narrow lanes, steep hills, tight turns and a guardrail that is too low. There are also no breakdown lanes on the parkway. These dangerous conditions played a part in at least 17 traffic accident deaths on that roadway, safety advocates say.
ABC News apparently received correspondence from the state Department of Transportation that there was a plan to install a new barrier and full shoulders, but the money to fund the projects was not available. The section of roadway where this accident occurred is on the state department’s “5 percent list,” which is a federally mandated report of locations that have the “most severe safety needs.”
Families that have lost loved ones as a result of dangerous or defectively designed roadways can file a wrongful death claim against the governmental agency responsible for maintaining those roadways. Please remember that there are statutes of limitations when it comes to filing governmental claims. Damages may be sought for lost future income and benefits, medical expenses, funeral costs, pain and suffering etc.
