A 55-year-old woman was injured in a pedestrian accident and is in a medically-induced coma after she was hit by a racing bicyclist in the park. According to the Gothamist, the Brooklyn woman was in Prospect Park and she stepped on West Drive when the cyclist struck her. The woman was conscious after she was hit, but doctors opted to put her in a coma after she got to the hospital. The cyclist stayed at the scene and refused any medical help. Earlier this year, a petition was circulated to make the Prospect Park bike lane safer for pedestrians after another person was hit by a cyclist and suffered brain damage. In both accidents the cyclists stopped until authorities arrived. A study was conducted that showed cyclists hit more walkers than people previously thought.
According to a study done by Hunter College, there are about 1,000 people hit by cyclists every year in New York. In many of these cases, the pedestrians had to be hospitalized for treatment of injuries. Over a three-year period there were more than 4,000 accidents in New York, most of which happened in 2008. The study also shows Brooklyn is the hot spot for these kinds of accidents, followed by Manhattan.
According to Transportation Alternatives, a nonprofit that advocates safety on New York Streets, cyclists are required to yield to pedestrians and always be aware of walkers or joggers on any pathways in parks or in the city. If it is found a cyclist was negligent, he or she may be responsible for any injuries caused. Just like motorists, cyclists are expected to exercise caution when operating a bicycle to ensure the safety of those around them.
A pedestrian hit by a cyclist can suffer very serious injuries, especially if that cyclist is traveling at a high rate of speed. Injuries can include brain damage, broken bones, and cuts and bruises. It is important to remember you do not have to suffer serious injuries or be hospitalized to file a claim. You may be entitled to seek compensation for damages including, but not limited to, medical expenses, lost wages and benefits, and past or future pain and suffering.
