A family received an $8.5-million settlement after their child suffered irreversible brain damage because of a hospital’s failure to act quickly. According to a news report in the Jersey Journal, the birth injury occurred back on August 4, 2005 at the Bayonne Medical Center in New Jersey.
According to the report, the delivery room nurse waited almost a half hour before calling the obstetrician when the baby’s heart rate plunged to a dangerous low. It took the doctor another 22 minutes to arrive, and he did not immediately perform the emergency Cesarean section. The delay in performing the C-section resulted in the fetus’ brain to be deprived of much-needed oxygen. The child, who is now 5, has suffered permanent brain damage. The boy cannot see, walk, eat normally or hold his head up on his own.
Medical facilities and doctors are required to not only provide a reasonable level of care to their patients, but should also provide that care quickly and in a timely manner. A failure to act can be just as dangerous as taking the wrong action. Babies and fetuses are in an extremely vulnerable state during labor and delivery and it only takes a moment of negligence for a serious birth injury or fatality to occur.
Whenever a birth injury occurs, it is in the best interest of the family to seek guidance regarding their legal options. Depending on the cause of the injury, the family may be able to seek financial compensation by filing a medical malpractice lawsuit. A skilled New York catastrophic injury attorney can help a family receive compensation for losses that include, but not limited to medical expenses, cost of rehabilitation, long-term care, past and future pain and suffering, and emotional distress.
