Autistic Man Branded with Potato Masher at Bronx Group Home

A severely autistic 24-year-old man was branded with a searing-hot potato masher by at least one employee at a Bronx group home for the mentally disabled. According to a report in the New York Daily News, a negligence lawsuit
filed against the Leake & Watts Residential facility alleges that the incident left the victim physically and emotionally scarred. The lawsuit, filed in Bronx Supreme Court, states that the man has the mental capacity of a toddler and was incapable of even identifying the person who attacked him.

The complaint also states that he has been permanently disfigured by the distinctive pattern of the potato masher. His family members say he will relive the incident in this mind because he cannot explain what happened to him or who did this to him. The negligence lawsuit names former employees who have now been fired.
The police arrested one of them, but charges were dropped because of insufficient evidence, specifically because the victim was not able to identify the perpetrator due to his limited mental capacity. The state’s Office of People with Developmental Disabilities, which licenses group homes, is investigating this incident.
What is Negligence?
Negligence is defined as the failure to use the degree of care that a reasonable person would have used under the same circumstances. Protecting others from harm means that people take the steps necessary to ensure that their dependents, customers, clients and the public at large is safe from foreseeable risk. Negligence often involves an incident that could have been prevented or could have been avoided but for a reckless, careless or deliberate act.
