Man Killed in Pedestrian Accident Involving Motorcyclist

A 73-year-old man was fatally injured in a pedestrian accident, which officials say, involved a motorcyclist. According to a news report on DNAinfo.com, the victim was struck by a motorcyclist headed east on West 96th Street as he crossed the street at Amsterdam Avenue. The motorcyclist remained at the scene. Officials are still looking into who had the right of way at the time. The pedestrian suffered severe head trauma and was transported to an area hospital. He died the following day after being taken off life support.

His family members are looking for help from the public to find out how this collision occurred. Police have not yet deemed this a criminal incident. The accident is still under investigation. The victim’s son has stated that he believes the motorcyclist must have been going over the speed limit given the “horrific” nature of the pedestrian’s head injury. The family is asking that anyone who witnessed the crash or has information reach out to them by emailing helptommac@gmail.com.
Devastating Injuries
Motorcycles hitting pedestrians can result in horrific injuries or even death as seen in this particular case. Motorcycle versus pedestrian accidents can cause a number of serious injuries including, but not limited to:
• Head trauma: When a pedestrian is struck by a motorcycle, he or she may fall to the ground and suffer serious head injuries. These injuries may range from concussions to skull fractures or brain bleeds. Such head trauma may even result in a fatality.
• Spinal cord damage: When a pedestrian accident victim falls on his or her back, there is the risk of suffering severe back or neck injuries. When the spinal cord is broken or severed, the victim may even become paralyzed. Such injuries often result in lifelong disabilities.
• Broken bones: Depending on the nature and intensity of impact between the pedestrian and motorcycle, the pedestrian may suffer multiple broken bones. These types of injuries take a considerable amount of time to heal. Victims may require extensive rehabilitation and therapy to completely recover from their injuries. Sometimes, even with rehabilitation, victims may not fully heal from such injuries.
• Internal organ damage: Blunt force trauma can also lead to significant internal organ damage or injuries to internal organs such as the heart, lungs, spleen, liver, kidneys, etc.
What Causes These Accidents?
There are a number of reasons why motorcycle versus pedestrian accidents occur. One of the most common causes is speeding on the part of the motorcyclist. When the rider exceeds the posted speed limit on the roadway or rides at a speed that is unsafe given the traffic conditions on the street, then, he or she is putting others, especially pedestrians, in harm’s way. Other factors that may lead to motorcycle versus pedestrian accidents include driving under the influence of alcohol and/or drugs, failing to yield the right-of-way to pedestrians, running a red light or a stop sign, distracted driving, inattention, etc.
In such types of injury accidents, the at-fault parties can be held liable for the injuries, damages and losses caused. Often, these individuals may not be criminally charged by law enforcement. This is typically the case when prosecutors do not think the element of criminal negligence can be proved beyond a reasonable doubt, which is required for a guilty verdict. The at-fault party may or may not receive even a citation from law enforcement officials for breaking the rules of the road. However, none of this is required for a victim to bring an injury lawsuit or the family of the deceased victim to bring a wrongful death lawsuit against the defendants.
Compensation for Injured Victims
Injured victims of pedestrian versus motorcycle accidents can seek compensation for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in motorcycle accidents can also seek compensation for their significant losses by filing a wrongful death claim.
